1. Scope of application
These General Terms and Conditions (GTC) govern the legal relationship between the customers, hereinafter referred to as guests, and Hotel Alpina, hereinafter referred to as the Hotel. Where the term "guest" is used below, it also includes the female or gender-neutral form. The GTC apply to all contracts for accommodation services and/or events, including related services. For the sake of simplicity, these GTC always refer to a contract, regardless of the service in question. The contractual parties are the guest and the hotel. Should individual provisions of these GTC be or become invalid or ineffective, this shall not affect the validity of the contract and the remaining provisions of the GTC. Lucerne shall be the place of jurisdiction for any disputes arising from this contract, unless another legally mandatory place of jurisdiction exists. Swiss law shall exclusively apply to all contracts, reservations, any additional agreements, and the general terms and conditions. Lucerne shall be the place of performance and payment.
2. Conclusion of ContractThe contract for the rental of rooms and other areas within the hotel, as well as outdoor areas belonging to the hotel property, as well as the provision of other goods and services, shall be concluded upon written confirmation by the guest and the hotel. Electronic documents such as emails and online generated forms shall also be considered as written confirmations. The agreed services are legally binding for both the hotel and the guest in every respect.
3. Prices
The prices communicated by the hotel are in Swiss Francs (CHF) and include the statutory value-added tax. Any increase in statutory levies after the conclusion of the contract shall be borne by the guest. Price changes are subject to change at any time.
4. Payment Modalities
4.1 Deposit / Prepayment
The hotel shall debit the entire booked service with the specified payment method as soon as the booked service is no longer cancellable free of charge. In the event of non-timely payment of the deposit, the hotel may immediately (without reminder) withdraw from the contract (including all promised services) and demand cancellation costs.
4.2 Credit Card Charge
By providing the credit card during booking, the guest agrees to its charge. A receipt is thus valid even without a signature or entering the PIN.
4.3 Final Invoice
The final invoice includes the agreed price plus any additional amounts incurred due to additional services provided by the hotel for the guest and/or accompanying persons. The final invoice must be paid in Swiss Francs in cash or by accepted debit or credit card at the latest during check-out on the departure day. Invoices sent by agreement must be settled within 10 days from the invoice date. The complete billing address must be provided at the time of the final reservation. The guest is liable for any unpaid invoices of individual participants. The invoiced amount must be paid without deduction. No discounts or rebates are granted on the amount owed.
4.4 Reminder Procedure
No costs will be charged for sending a first reminder. Each subsequent reminder level will be charged a processing fee of CHF 50 and any default interest of 5% p.a.
4.5 Invoice Amendment
A change of the billing address after the invoice has been sent will be charged a processing fee of CHF 20 per invoice.
5. Options, Offers
5.1 The acceptance periods for offers from the hotel are specified in the respective offer. After that, the hotel is no longer bound to the offer.
5.2 Option Dates are binding for both parties. After the unused expiry of the option period / offer, the hotel can dispose of the offered services without further notice.
5.3 Rooms are always offered subject to availability. An intermediate sale is thus possible at any time.
6. Reservation, Check-in and Check-out
6.1. A reservation made on the day of arrival itself is binding at the moment of acceptance by the hotel.
6.2. Arrival If, upon arrival, the booked room category is not available due to unforeseen reasons, the guest will be assigned a room of the next higher category.
6.3. If, despite a confirmed reservation, no rooms are available at the hotel, the hotel must offer the guest an equivalent replacement in a nearby (25km as the crow flies) hotel of a comparable or higher category. Any additional expenses for the replacement accommodation shall be borne by the hotel. If the guest declines the replacement room, the hotel must promptly refund any services already provided by the guest (e.g., deposits). Further claims by the guest do not exist.
6.4. Subject to other agreements, the guest is entitled to use the rented rooms from 4 pm on the agreed day of arrival until 11 am on the day of departure.
6.5. If the guest departs early, the hotel is entitled to charge 100% of the booked services.
6.6. The hotel room is reserved exclusively for the registered guest or guests. The transfer of the room to a third party or its use by an additional person requires the approval of the hotel.
6.7. The scope of services under the contract is determined by the individually made and confirmed reservation of the guest.
6.8. The customer may only use the rooms for the agreed purpose.
7. Cancellation and Rescheduling
For a reservation of 1 to 4 hotel rooms, cancellation is free of charge up to 48 hours before arrival. For later cancellations or no-shows (guests not showing up), the costs for the entire stay will be charged. If the booking guest registers additional guests, he/she is liable for the entire invoice amount resulting from the reservation. Exceptions to these cancellation costs, such as during trade fairs or dates defined by the hotel, can be found in the booking confirmation.
8. Group Reservations Definition
As groups within the meaning of these GTC, room reservations with a minimum of 5 booked rooms are considered.
9. Guest List
The final list of names of each member of the respective group must be communicated to the hotel up to 14 calendar days before arrival.
10. Cancellation and Rescheduling
Up to 42 calendar days before arrival, cancellation is free of charge. In the event of a later cancellation, the following charges apply:
41 to 22 days before arrival 50% of the contractually agreed services
21 to 0 days before arrival 100% of the contractually agreed services. Further provisions
11. Right of Withdrawal
The hotel is entitled to withdraw from the contract at any time (even after the regular cancellation period) for valid reasons by immediate unilateral and written declaration. Valid reasons include, for example:
• An agreed prepayment or security deposit is not made within the period set by the hotel;
• Force majeure (according to Art. 119 of the Swiss Code of Obligations) or other circumstances beyond the control of the hotel that objectively make it impossible to fulfill the contract;
• Rooms or spaces are booked or used under misleading or false information, e.g., regarding the guest's identity or the purpose of use or stay;
• the hotel has reasonable grounds to believe that the use of the agreed services may affect the smooth operation of the business, the safety of other hotel guests, or the reputation of the hotel;
• the guest has become insolvent (bankruptcy or fruitless attachment) or has ceased payments;
• the purpose or occasion of the stay is unlawful. In the event of the hotel's withdrawal for the aforementioned reasons, the guest shall have no claim to damages, and compensation for the booked services remains generally owed.
12. Internet
The hotel provides the guest with free Internet access (WLAN). The guest is responsible for the use of the login data. He/she is liable for misuse and illegal behavior when using the Internet.
13. Smoking
Smoking is not permitted throughout the hotel. In case of violation, a fee of CHF 350.- will be charged.
14. Liability
Personal belongings brought along are at the guest's risk in the rooms or on the hotel premises. The hotel assumes no duty of surveillance and safekeeping. The hotel shall not be liable for the loss or damage of brought belongings, except in cases of gross negligence or intent on the part of the hotel. The insurance of brought belongings is the responsibility of the guest. If valuables such as jewelry, cash, or securities are not handed over to the hotel for safekeeping, the hotel's liability for loss is waived within the legal limits. The hotel waives liability towards the guest within the legal limits for slight and medium negligence and shall only be liable for damage caused intentionally or through gross negligence. If disruptions or defects occur in the hotel's services, the hotel will endeavor to remedy them immediately upon the guest's notification. If the guest fails to report a defect to the hotel in a timely manner, there is no entitlement to a reduction of the contractually agreed remuneration. The guest is liable to the hotel for all damages and losses caused by him/her, his/her companions, or helpers, without the hotel having to prove fault. The guest is liable for services and expenses incurred by the hotel towards third parties. If a third party makes the booking for the guest, he/she is liable to the hotel as the contracting party together with the guest as joint debtor for all obligations arising from the contract. Regardless of this, every booker is obliged to forward all booking-relevant information, especially these General Terms and Conditions, to the guest.
15. Dogs
Dogs are only allowed in the hotel with prior approval from the hotel and against a special fee of CHF 20.- per day. The guest bringing an animal into the hotel is obliged to keep it properly and supervise it during its stay, or, at his/her own expense, have it properly kept or supervised by suitable third parties. The guest shall bear the costs for the removal of damages or contamination caused by the animal.
16. Lost Property
Lost property will be sent back if ownership is clearly identifiable and the residential or business address is known. The costs and risks of re-dispatch shall be borne by the guest.
17. Media
Advertisements in media (such as newspapers, radio, television, internet) using the company logo or photos require prior written consent from the hotel.
